Irish Pension Transfer to India: The Employment Rule to Check First

Moving home and moving a pension are separate decisions. For a possible transfer from Ireland to India, your current country of employment is an early question to resolve.

Can you transfer an Irish pension to India?

A transfer may be possible in an eligible case, but returning to India does not establish eligibility by itself. Irish Revenue’s Pensions Manual, Chapter 13 states that, for a destination outside the EU, the transfer country must be the member’s current country of employment. It also requires checks on the receiving scheme’s benefits and regulatory approval, supported by written confirmation.

For someone considering India, the useful opening question is therefore: “Does my current employment position meet the Irish conditions for this particular transfer?” A residence document alone does not answer that question. Nor does a receiving provider’s marketing description.

Identify the pension before discussing a route

Ask the existing provider to identify your arrangement precisely: an occupational pension, PRSA, buy-out bond or another product. Record whether benefits have started, whether a transfer value is available, and which rules the provider says apply. A guide to one category is not a substitute for confirmation about your own contract.

The Irish Pensions Authority’s overseas-transfer guidance explains that trustees or PRSA providers must satisfy themselves about the proposed receiving arrangement. Ask the ceding provider for its evidence requirements before committing to a receiving product.

Three situations that need different questions

Illustrative starting points, not eligibility decisions
Your situationQuestion to resolve first
You now work in IndiaWhat employment evidence and receiving-scheme confirmations does the Irish provider require?
You returned to India and are retiredHow does the current-employment condition apply to your pension and circumstances?
You live or work in another countryWhich destination, if any, can the ceding provider consider under the applicable rules?

These questions are deliberately different. A family address in India, plans to return later, and a current job in India describe different facts. Set them out separately in your enquiry so the provider is not asked to make a decision using an incomplete picture.

Is an Irish transfer the same as a UK QROPS transfer?

No. QROPS is a UK tax framework. An Irish-origin pension needs an Irish transfer analysis. If you also hold a UK pension, maintain two case files, two sets of provider requirements and separate tax questions. A scheme being relevant to one country’s process does not establish eligibility under the other country’s rules.

Do not treat a transfer through a third country as an automatic solution to a restriction. Revenue’s guidance addresses bona fide transfers and arrangements intended to circumvent retirement-benefit rules. Any proposed multi-country route needs its own documented legal and tax analysis.

Build a useful provider enquiry

  1. Identify the existing pension: provider, exact product name, member reference and benefit type.
  2. Explain your position: where you live, where you currently work, and whether retirement benefits have begun.
  3. Identify any proposed receiver: exact legal scheme name, administrator, regulator and current acceptance terms.
  4. Compare the contract: access terms, income choices, costs, death benefits and any guarantees you would surrender.
  5. Separate the tax questions: the transfer itself, later withdrawals and reporting may require different advice.

Use an initial enquiry to clarify which documents are needed. Share identity documents and statements only through an agreed secure channel; you need not send a full document pack in a first WhatsApp message.

What if a transfer cannot proceed?

Ask for the reason in writing and explore the options available within your existing pension. A useful review should still explain how the arrangement fits your retirement plans when an overseas transfer is unavailable. Do not select a product first and try to fit the rules around it afterwards.

Questions people ask

Is an Indian passport enough to transfer?

No. Nationality does not replace the employment, scheme and provider checks relevant to the proposed transfer.

Can you confirm eligibility before seeing my pension details?

A responsible assessment starts with your actual arrangement and circumstances. A headline transfer value or country of residence is not enough.

Can I leave my pension in Ireland?

Ask your provider to explain the options under your existing scheme, including access, administration and payments while living abroad. Include those options in your comparison.

Start with the questions in your case.
